2. Payment and Cancellation
Payment: Full payment is due on the day of the photo shoot.
Cancellation and Refund: Clients may reschedule or transfer payment within 2 weeks of the photo shoot. Refunds are only available within 72 hours after payment. No refunds are available after the photo shoot.
3. Intellectual Property
Photograph Rights: The Photographer retains copyright. Clients grant the Photographer the right to use photos for promotional purposes. Clients may use images for commercial purposes related to their business.
4. Disclaimers and Limitation of Liability
Photography Services:
Laura Katelin LLC (referred to as "the Photographer") provides photography services on an as-is basis. The Photographer makes no warranties or representations regarding the outcome or quality of the photographs.
No Guarantees:
While the Photographer strives to capture high-quality and professional images, there are inherent challenges in photography, including variations in lighting, weather conditions, and the unpredictability of subjects. The Photographer does not guarantee specific results.
Limitation of Liability:
In no event shall the Photographer be liable for any direct, indirect, special, incidental, or consequential damages arising out of the use of or inability to use the photography services, including but not limited to lost profits, loss of data, or loss of business, even if the Photographer has been advised of the possibility of such damages.
Copyright and Usage:
The Photographer retains the copyright to all photographs. The Client is granted a non-exclusive, non-transferable license to use the photographs for personal and commercial purposes related to their business. The Photographer may use the photographs for promotional purposes.Client Responsibility: The Client is responsible for providing accurate and clear instructions to the Photographer. The Photographer is not liable for dissatisfaction with the results due to unclear or inaccurate information provided by the Client.
Force Majeure:
The Photographer shall not be liable for any failure or delay in the performance of services due to circumstances beyond their control, including but not limited to acts of nature, government actions, or other unforeseen events.
5. Dispute Resolution and Governing Law
Dispute Resolution:
Any disputes shall be resolved through arbitration in accordance with AAA rules.
Governing Law: These terms are governed by the laws of the state of New Jersey. Legal actions shall be brought in the state or federal courts within New Jersey.
